1. Scope of Application, Changes to the Terms of Use
1.1. SHOWCAST GmbH & Co. KG, Marspfortengasse 6, 50667 Cologne, Germany (hereinafter referred to simply as SHOWCAST) provides users with the services available on the online portal www.showcast.de based on these Terms of Use. By registering on www.showcast.de and/or using the services provided there by SHOWCAST, the user agrees to the validity of these Terms of Use.
1.2. The Terms of Use can be printed and/or digitally saved by the user, especially prior to registration. 1.3. SHOWCAST reserves the right to amend the Terms of Use with effect for the future. In this case, SHOWCAST will notify the user of the changes to the Terms of Use at least two weeks in advance, informing the user that the changes will be deemed accepted if the user does not object to the changes within a period of two weeks from the notification.
1.4. Deviating regulations in the user's General Terms and Conditions as well as changes, deletions, and additions to these Terms of Use by the user are only valid if confirmed by SHOWCAST.
2. Content, Registration, Requirements
2.1. As a casting and model agency, SHOWCAST books and places models, actors, presenters, and other artists (hereinafter referred to as talents). In doing so, SHOWCAST primarily relies on talents who have registered on www.showcast.de and keep their respective profiles updated. Registered talents are given the opportunity to confirm job requests and the like (so-called "options") submitted by SHOWCAST via the project management component provided on www.showcast.de. Otherwise, the booking or placement of talents is not governed by these Terms of Use, but by the respective contractual terms of SHOWCAST for use towards talents via the project management component provided on www.showcast.de.
2.2. Only talents who have reached the age of 16 are entitled to register. Talents under the age of 18 require the consent of their legal guardian to register.
2.3. Registration is free of charge. It serves in particular as an application for inclusion in the database maintained by SHOWCAST on www.showcast.de. SHOWCAST provides the user with an online registration form for this purpose. The registration form provided by SHOWCAST does not constitute a binding offer for inclusion in the database. By sending the registration form by clicking the registration button, the user initially only makes a binding offer to SHOWCAST for inclusion in the database maintained by SHOWCAST on www.showcast.de.
2.4. The talent has no legal entitlement to be included in the database maintained by SHOWCAST on www.showcast.de. The talent will not receive a notification regarding rejection/non-inclusion. Furthermore, even after successful inclusion and activation of their profile, the talent has no claim to be booked for assignments by SHOWCAST.
2.5. Upon registration, the talent is obliged to provide truthful, accurate, current, and complete personal information according to the specifications of the respective online form. The talent manages their profile page independently. They must keep their data up to date and correct at all times. Image material must accurately represent the user and must not be older than 2 years.
3. Termination, Modification/Deletion/Blocking of the Profile
3.1. The user can delete their profile at any time without providing reasons. The stored data and information will then be automatically deleted by SHOWCAST. To do this, the user must send an email from the address they used to register with SHOWCAST to
3.2. SHOWCAST is entitled, at its own discretion, at any time and without giving reasons, to delete the user's password, block their profile, or delete content posted there in whole or in part, or publish it elsewhere within the offering, or prevent any other use of the services by the user.
4. User Obligations
4.1. The user is fully responsible for the contents of their profile and for all activities carried out via it—such as, in particular, the confirmation of options submitted to them according to section 2.1 sentence 3 via the project management component provided on www.showcast.de and any contract conclusion bindingly established thereby. This also applies insofar as the user has granted a third party access to their profile—for instance, by sharing their password—as well as for any misuse by third parties who are in possession of the password for whatever reason.
4.2. The user is obliged to inform SHOWCAST immediately of any abusive use of their password.
4.3. The user commits to refraining from actions that could impair the functionality of the services provided by SHOWCAST.
5. Image Rights, Indemnification
5.1. SHOWCAST is entitled to use the image and/or video material posted by the user on their profile page free of charge, e.g., to promote the respective talent or to promote the services of SHOWCAST on blogs, websites, Instagram, Twitter, Facebook, or similar platforms, in particular to publish it. The same applies to image and/or video material that the user has otherwise provided to SHOWCAST.
5.2. The user guarantees that the image material they provide is free from third-party rights and may be published.
5.3. If SHOWCAST is subject to claims by third parties due to the exploitation of the image material posted by the talent on their profile page, the user shall indemnify SHOWCAST against liability and thus against all associated financial and other disadvantages. This also includes own legal and court costs as well as any to be reimbursed to third parties.
5.4. The user expressly grants SHOWCAST the right to have the uploaded image and video material as well as profile texts processed, analyzed, and tagged automatically by internal and external Artificial Intelligence (AI) systems and machine learning algorithms. This serves exclusively to optimize the internal placement process (e.g., intelligent matching of model characteristics with client requests, automated tagging). The use of the material for training open, generative AI models by third parties not acting on behalf of SHOWCAST is contractually excluded by SHOWCAST with the respective providers, insofar as this is technically and legally possible.
6. Data Protection
6.1. By registering on www.showcast.de, the talent agrees that SHOWCAST stores and processes personal data of the talent that becomes known to SHOWCAST in the course of the business relationship. Personal data will be treated strictly confidentially and processed and stored only to the extent necessary for the proper execution of the contract. In doing so, SHOWCAST will—as always—observe all data protection requirements, particularly the provisions of the GDPR and applicable national data protection laws.
6.2. By registering on www.showcast.de, the talent also expressly consents to the personal data provided in the publicly accessible profile being stored, processed, and in particular published for the purpose of using the website and for retrieval by internet users.
6.3. Upon request, SHOWCAST will provide the talent with information about the data stored concerning their person or username. The information is provided in text form (e.g., letter, fax, or email). If the user's profile is deleted by whomever, the data posted there will also be deleted by SHOWCAST.
6.4. SHOWCAST has taken a variety of security measures to protect the personal data of the talent that goes beyond the information contained in the talent's publicly accessible profile. In particular, this data is not passed on to third parties. However, SHOWCAST expressly points out to the talent that data protection for data transmissions in open networks, such as the internet, cannot be comprehensively guaranteed according to the current state of technology.
6.5. SHOWCAST uses cookies so that the talent can use the portal smoothly and easily. The cookies solely serve internal purposes: They are so-called session cookies containing the user's ID. This allows SHOWCAST to see whether the talent is logged in and thus authorized to access the content posted in their profile.
7. Liability and Limitation of Liability
7.1. SHOWCAST is only liable for intent and gross negligence, otherwise according to the Product Liability Act, for injury to life, body, or health, or for the culpable breach of essential contractual obligations. The claim for damages for the breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless there is also another case of mandatory liability according to sentence 1.
7.2. The provisions of paragraph 1 above apply to all claims for damages, regardless of the legal basis. They also apply to claims for reimbursement of futile expenses.
7.3. The aforementioned limitations of liability also apply in favor of SHOWCAST's representatives and vicarious agents.
8. Choice of Law, Jurisdiction, Severability Clause
8.1. These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
8.2. The exclusive place of jurisdiction for all disputes arising directly or indirectly from the use of the online offering provided by SHOWCAST is Cologne, provided the user is a merchant, a legal entity under public law, or a special fund under public law.
8.3. Should a provision in these Terms of Use be or become invalid, the validity of all other provisions or agreements shall not be affected. If the user is a merchant, a legal entity under public law, or a special fund under public law, the parties will replace the void provision with a valid one that comes closest to the economic intent of the parties.
